Paternity
In today's society, there are many couples that are choosing to have children together but are not married. When the relationship ends, much like in a divorce, child custody/ visitation and child support are at issue. The Law Offices of Diamond, Burt & Akhkashian, LLP, have helped many parents who find themselves in this situation. We have obtained legal custody for parents who have found themselves in heated custody fights. While these parents do not have to go through divorce proceedings, they still have to go through what's called a 'Paternity Action' to establish custody over his/her child.
DNA paternity testing enables science to determine with greater certainty who is the biological father, but the issue of who is a legal parent can be less clear. For example, parties in same-sex relationships who have either adopted or parented children may become involved in a custody dispute if the relationship ends. We always recommend DNA testing to be certain that an 18-year support obligation, that is both financial and emotional, is based on the reality of parenthood.
An unmarried father's paternity rights and responsibilities can only be legally confirmed in a court through paternity testing and the establishment of legal parentage. Legal fathers have rights and responsibilities regarding child support, custody and visitation rights , and are entitled to be involved in parental decision-making regarding education, religious upbringing, and medical care and the mothers are entitled to enforce such responsibilities on the fathers.
Paternity suits are confidential and cannot be accessed by anyone other than both parents and their lawyers. The same judges that hear divorces hear paternity cases.
